kaged Pre-Release Evaluation License

Version 1.0 — applies to pre-release (0.0.x) builds distributed via kaged-releases.

This is a license agreement between you ("You") and kaged-dev ("Licensor") for the pre-release kaged software and any files distributed with it (the "Software"). By downloading, installing, or running the Software, You agree to these terms. If You do not agree, do not download, install, or run the Software.

This is not an open-source license. It grants limited rights to use a pre-release binary and nothing more. Source code for the Software is not made available under this license.

1. License grant

Subject to these terms, Licensor grants You a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and run the Software solely for the purposes of evaluation, testing, and Your own internal use.

2. Pre-release status

The Software is pre-release. It is provided for testing only, may be incomplete or unstable, may contain defects, and may change, break, or be withdrawn at any time without notice. Licensor has no obligation to provide updates, bug fixes, support, or maintenance, and no obligation to release any general-availability version.

3. Restrictions

Except as expressly permitted above, You may not:

• redistribute, sell, rent, lease, sublicense, or otherwise make the Software available to any third party;
• offer the Software, or any service based on it, to third parties (including as a hosted or managed service);
• remove, alter, or obscure any copyright, license, or attribution notices; or
• reverse engineer, decompile, or disassemble the Software, except to the extent that this restriction is expressly prohibited by applicable law.

4. Reservation of rights

All rights not expressly granted are reserved by Licensor. No title to or ownership of the Software is transferred. Nothing in this license grants You any rights to the Software's source code.

5. Open-source components

The Software incorporates components that are separately licensed under their own terms, including components licensed under the GNU Affero General Public License v3.0 (AGPL-3.0). Those components remain governed by their respective licenses, and nothing in this license limits any rights You have under them. A list of such components and their licenses is provided with the Software or in the kaged-releases repository.

6. No warranty

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. YOU USE THE SOFTWARE AT YOUR OWN RISK. THIS IS PRE-RELEASE SOFTWARE AND MAY CAUSE LOSS OF DATA OR OTHER HARM; YOU ARE RESPONSIBLE FOR BACKING UP YOUR DATA AND SYSTEMS.

7. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, OR BUSINESS, ARISING OUT OF OR IN CONNECTION WITH THE SOFTWARE OR THIS LICENSE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL AGGREGATE LIABILITY UNDER THIS LICENSE SHALL NOT EXCEED ZERO.

Nothing in this license excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or for willful misconduct.

8. Term and termination

This license is effective until terminated. It terminates automatically if You breach any of its terms, and may be superseded when Licensor releases a general-availability version under different terms. On termination, You must stop using the Software and destroy all copies in Your possession. Sections 4 through 9 survive termination.

9. Governing law

This license is governed by the laws of Hungary, without regard to its conflict of laws rules. The courts of Budapest, Hungary shall have exclusive jurisdiction over any dispute arising out of or relating to this license, except where mandatory consumer-protection law grants You the right to bring proceedings elsewhere.

10. General

This license is the entire agreement between You and Licensor regarding the Software and supersedes any prior understanding. If any provision is held unenforceable, the remaining provisions remain in effect. Licensor's failure to enforce any provision is not a waiver of it.
